What exactly is being contracted, what it costs, what happens if something changes, and how far my responsibility goes.

In four lines
I am not a travel agency and I do not sell trips. I design your journey and, if you commission it, I coordinate its execution. You contract and pay each supplier directly, and I take no commission from any of them. Everything below develops those four ideas.

These terms govern the contracting of the services offered by AMG Viajes through amgviajes.com. Below, "the client" means the individual or organisation contracting the service, acting in their own name or as representative of the group of travellers.
2 · Nature of the service
AMG Viajes is not a travel agency. It does not organise, market or sell package travel or linked travel arrangements. The services provided correspond to consultancy, advice, design and coordination of journeys.
Accordingly:
- AMG Viajes does not contract or resell flights, accommodation, transport, activities, insurance or any other travel service.
- The client, or each traveller, contracts and pays directly for those services to their respective suppliers, and is subject to each supplier's own terms.
- AMG Viajes receives no commission, remuneration or consideration from hotels, ground operators, guides, carriers or activity providers. Its only remuneration is that paid by the client under section 4.
- AMG Viajes does not hold or handle the money used to pay for the travel services.
The client will know at all times where their money goes and will receive information on the estimated total cost of the journey, with no hidden costs.
3 · Services and phases
Phase A · Design of the journey
Research and preparation of a travel proposal for the group, delivered as a dossier. It includes:
- The route explained day by day.
- Reasoned options for accommodation, transport and experiences, with named suppliers.
- An indicative budget per person and a breakdown by item.
- Relevant decisions, identified risks and alternatives.
- A booking calendar and the documentation required.
- One meeting to present the dossier.
- One reasonable round of adjustments, under section 6.
Phase A does not include any booking, any held places and any payment to suppliers. The prices in the dossier are working estimates, not firm offers, and may vary depending on the date of contracting and availability.
Phase B · Coordination and accompaniment
Optional and contracted separately, by individual quotation, once the client has approved the design. It may cover coordination of bookings with suppliers, preparation of the group's documentation, pre-departure assistance and accompaniment during the journey.
The precise scope, price, recoverable expenses and cancellation conditions of Phase B will be set out in writing before it is contracted.
4 · Price and payment
The price of Phase A is €500 plus VAT for the group as a whole, unless another amount is agreed in writing on grounds of complexity, duration or number of destinations.
- 50 % on confirmation of the commission, as a condition for the work to begin.
- 50 % once the dossier is complete, prior to its delivery and presentation.
If the client subsequently contracts Phase B with accompaniment during the journey, the amount paid for Phase A will be deducted in full from that quotation. Where Phase B covers coordination only, without accompaniment, no such deduction applies.
Payments are made by bank transfer or Bizum to the account provided on confirmation of the commission. Prices are in euros and include VAT where so stated. An invoice will be issued for each payment, in the name of the client or the group's representative, as agreed.
5 · Contracting process
- The client submits the request form on the website. Doing so creates no obligation for either party.
- AMG Viajes reviews the request and, if it considers that it can add value, proposes a preliminary conversation at no cost and with no commitment.
- If both parties wish to continue, AMG Viajes sends the commission document in writing, with the scope, price, deadlines and these terms.
- The client accepts the commission in writing and pays the first 50 %. Work then begins and the delivery period starts to run.
- AMG Viajes delivers the dossier within an estimated 15 to 20 calendar days of confirmation, upon payment of the second 50 %, and presents it to the client.
- The client has 30 calendar days from the presentation to request the included round of adjustments.
The delivery period is an estimate and may be extended for justified reasons, of which the client will be notified in advance. It is also suspended while AMG Viajes is waiting for essential information to be supplied by the client.
AMG Viajes reserves the right not to accept a commission, without having to give reasons. In that case no cost arises for the client.
6 · Adjustments and changes
Phase A includes one reasonable round of adjustments to the proposal delivered: changes of accommodation, reordering of days, substitution of activities or adaptation to a different budget within the same destination and approximately the same dates.
A change of destination, a change of season or of dates requiring the research to be redone, a substantial variation in the number of travellers, or any modification that significantly alters the structure of the journey, will be treated as a new commission, subject to a separate quotation.
If the 30 calendar days from presentation pass without the round of adjustments being requested, it will be deemed unused and Phase A will be complete.
A delivered dossier retains its conceptual validity, but supplier prices, availability and conditions are subject to change over time. If the journey takes place more than six months after delivery, a review will be required and quoted separately.
7 · Right of withdrawal
Where the client is a consumer, they have fourteen (14) calendar days from the conclusion of the contract to withdraw without giving reasons, by writing to hola@amgviajes.com.
Since the design work begins immediately after the commission is confirmed, by accepting the commission the client expressly requests that performance of the service begin during the withdrawal period and acknowledges that, if they withdraw once work has begun, they must pay an amount proportionate to the service already provided up to the point of notification. If the service has been fully performed within that period, the right of withdrawal is extinguished.
This right does not apply where the client contracts in the course of a business or professional activity.
8 · Cancellations
By the client
Outside the withdrawal period, and depending on the work already carried out, the following refund criteria apply to the amount paid for Phase A:
- Before work has effectively begun: full refund of the amount paid.
- Research begun and dossier not completed: the client does not recover the first 50 % already paid, which remunerates the work carried out to that point, and is released from paying the second 50 %.
- Dossier completed, even if the client declines to receive it: the service has been performed in full and the second 50 % remains payable.
- Proposal delivered or presented: no refund applies.
These amounts are not penalties: they remunerate the research and design work actually carried out, which cannot be reused for other clients.
Cancellation of the journey by the group, a reduction in the number of travellers or a failure to reach agreement within the group do not give rise to any refund of design work already completed.
By AMG Viajes
AMG Viajes may terminate the commission, refunding in full the amounts paid and with no further obligation, in cases of force majeure, supervening impossibility of providing the service, or where the requested destination is inadvisable under the official advice referred to in section 10.
It may also terminate the commission, with no right to a refund, if the client provides false information, breaches these terms, or fails to supply information essential to the work after a written request and a reasonable period.
9 · Liability
AMG Viajes is liable for the proper provision of its own design services and, where applicable, coordination and accompaniment, in proportion to its involvement and in accordance with the diligence required of a professional in the sector.
It is not liable, as these do not form part of its service:
- For the performance of services contracted by the client with third parties, including accommodation, transport, catering, local guides and activities, which are governed by their own terms and are answerable to the client.
- For air transport incidents such as denied boarding, cancellations, delays or baggage problems. Each traveller is responsible for claiming their rights as a passenger.
- For variations in price or availability arising between delivery of the dossier and the effective contracting of the services.
- For damage resulting from decisions taken by the client contrary to the recommendations in the dossier.
Where AMG Viajes accompanies the group, its role is one of coordination and assistance. Activities proposed during the journey are voluntary, and each traveller freely decides whether to take part, doing so at their own responsibility.
10 · Obligations of the client and travellers
- Documentation. Each traveller is responsible for holding valid documentation for entry to and movement within the countries visited: identity document, passport with the required validity, visas, permits and health requirements. AMG Viajes provides information on known requirements but does not process them and is not liable for non-compliance.
- Travel insurance. Contracting travel insurance with medical, cancellation and repatriation cover appropriate to the destination is expressly recommended. It is for each traveller to arrange.
- Health and physical capacity. The client must notify any mobility limitations, accessibility needs or dietary restrictions that must be planned for. Diagnoses and medical reports should not be sent: simply state what needs to be taken into account. Each traveller assesses, at their own responsibility, whether their state of health is compatible with the planned activities.
- Truthful information. The client undertakes to provide accurate information about the group, the dates and the budget, on which the quality of the design directly depends.
- Safety and conditions at the destination. Reference is made to the travel advice of the Spanish Ministry of Foreign Affairs, European Union and Cooperation (exteriores.gob.es) and the health recommendations of the Ministry of Health (sanidad.gob.es). Having been made aware of that information, the traveller accepts the conditions inherent to the chosen destination.
In certain destinations, specialist medical assistance or rapid evacuation may be limited. The client acknowledges and accepts this.
11 · Intellectual property in the dossier
The dossier and other documents prepared by AMG Viajes are its own work and are protected by intellectual property law.
By paying for Phase A, the client acquires the right to use the dossier to make their own journey and to share it with the members of their group. They do not acquire ownership of the work.
It is expressly prohibited to assign, resell or hand it over to travel agencies, operators or other professionals in the sector for commercial use or reproduction, or to publish it in full or use it for commercial purposes, without prior written authorisation.
12 · Data protection
The processing of personal data provided is governed by the privacy policy. A client who provides data about other travellers warrants that they have their consent and undertakes not to provide unnecessary data.
13 · Amendment of these terms
AMG Viajes may amend these terms at any time. The version applicable to each commission is the one in force and accepted at the time of its confirmation, which is provided together with the commission document.
14 · Law and jurisdiction
These terms are governed by Spanish law. Any dispute shall be submitted to the courts having jurisdiction under the applicable rules, respecting in all cases the mandatory rules of jurisdiction applicable to consumers and users.
The client may also use the European Commission's online dispute resolution platform or the consumer services of their autonomous region.
